PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the first respondent to demolish the 10 feet compound wall put up by the fourth and fifth respondents and used his pathway for public peoples, based on the petitioner's representation dated 24.02.2025 within a specific period as fixed by this Court.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) This writ petition has been filed seeking a direction to the first respondent to demolish the 10 feet compound wall put up by the fourth and fifth respondents and used his pathway for public peoples, based on the petitioner's representation dated 24.02.2025 within a time frame. 2.According to the petitioner, the land in dispute is a pathway and the same has been blocked by putting up a compound wall. 2/5

3.The learned Additional Government Pleader appearing for the respondents 1 to 3, on instructions, would submit that the subject land in S.No.123/1 is allotted to the Police Department and now the Reserve Police has put up construction and there is no encroachments. 4.Such view of the matter, we do not find any merits in this writ petition. In the event, if the petitioner is having any easementary right, it is for him to establish the same by filing a suit before the concerned civil Court. Accordingly, this writ petition is dismissed. No costs.
