O R D E R

The petitioner has approached this Court seeking a direction to the respondent to comply with order dated 15.02.2024 made in Cr.MP.No. 916 of 2024, on the file of the learned Judicial Magistrate, Nilakottai and register the FIR within a stipulated time period.

2. The learned Additional Public Prosecutor appearing for the respondent submits that the respondent police has conducted an enquiry and has also filed a report before the learned Judicial Magistrate, Nilakottai, stating that no offence is made out in the case.

3. The learned Counsel for the petitioner relied on the judgment reported in 2024 (1) MWN (Cr.) 13, stating that once a direction was issued by the learned Judicial Magistrate under Section 156(3) of Cr.P.C., the respondent police has to register FIR on the basis of complaint forwarded by the learned Judicial Magistrate.

Since the respondent police has filed a report before the learned Judicial Magistrate, Nilakottai, stating that no offence is made out, this Criminal Original Petition is closed with a direction to the respondent police to furnish the copy of the report to the petitioner, enabling the petitioner to file a protest petition before the Court concerned, if so advised.
