Respondents PRAYER: Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents to pay the terminal benefits amount payable to the petitioner such as Provident Fund and Gratuity amount together with 6% interest from the date of dismissal, i.e., 14.03.2005 along with one month Notice Salary to him within a stipulated period. By consent of both the parties, this Writ Petition is taken up for final disposal.

2. The limited prayer sought in the present Writ Petition is for disbursement of the petitioner's terminal benefits of Provident Fund and Gratuity.

3. When the petitioner had sought for certain information under Right to Information Act, 2005 through the application dated 07.01.2022, the respondents, in reply dated 10.02.2022, had stated that a sum of Rs.23,320/- is payable towards Provident Fund and Rs.31,041/- is payable towards Gratuity to the petitioner. Since the respondents have admitted that the petitioner is entitled for the aforesaid amount towards Provident Fund and Gratuity, it would be https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.11905 of 2022 appropriate to direct the respondents to consider the petitioner's request in this regard. Incidentally, the petitioner had made a representation dated 06.05.2022 claiming terminal benefits.

In the light of the above observation, there shall be a direction to the second respondent to consider the petitioner's representation dated 06.05.2022 and disburse the Provident Fund and Gratuity amount admitted by them to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.

5. With this direction, this Writ Petition stands allowed. No costs.
