JUDGMENT
(Judgment of the Court was made by C.V.Karthikeyan, J.) The Writ Appeal has been filed by the respondents in W.P.(MD) No.3519 of 2020, aggrieved by the order of the learned Single Judge
dated 27.07.2020, whereby the learned Single Judge had interfered with the Notification issued by the Superintending Engineer, Public Works Department, Buildings (C & M) Circle (Medical Works), Madurai District, dated 18.12.2019, as well as the subsequent Notification in Tender Notice dated 13.01.2020, and had directed that a fresh tender Notification be issued in respect of certain construction activities at the Tirunelveli Medical College.
2. Aggrieved by the aforesaid directions, the present Writ Appeal has been filed.
3. In the meantime, it has been brought to our notice that the work had already been carried out by M/s.RSK Construction and Projects, Coimbatore. The details of the completed works, along with the fact that the building has been handed over, inaugurated, and is now functioning, have been furnished in a status report filed by the Chief Engineer (Buildings), Madurai Region, Madurai.
4. The relevant portion of the status report is extracted below:- ''4. The tender notification for this work, had been issued on 13.01.2020 by the erstwhile 5th appellant based on the Administrative Approval and Technical sanction accorded. The Tender had been opened on 24.02.2020 and the lowest one was accepted by the Tender Award Committee in the 338th TAC Meeting held on 15.05.2020. Consequently, the Agreement was signed by the lowest tenderer M/s.R.S.K. Construction and projects, No.12, 3rd Floor, Thirumurugan Nagar, Veeriyampalayam Road, Kalapatti Post, Coimbatore on 27.05.2020.
5. The work was carried out by M/s.R.S.K. Construction and Projects, Coimbatore under the Building Construction and Maintenance Division, Medical Works, Tirunelveli. All the Construction and Maintenance works in serial number 1 to 23 covered in Civil works had been completed and handed over to the user department on 31.03.2022 by the buildings Construction and Maintenance Division, Medical Works, Tirunelveli. Subsequently, the Govt. has issued orders by merging Medical and Non Medical works and re-organised Public Works Department vide G.O.Ms.No.77 PW(G1) Dept. Dt: 24.08.2022. In the above G.O., the Buildings Construction and Maintenance Division, Medical Works, Tirunelveli was ordered
to function as Buildings Construction and Maintenance Division, Tenkasi with effect from 07.09.2022 by Redeployment. Hence, the Medical Department works carried out by that office was handed over to Buildings Construction and Maintenance Division, Tirunelveli which is functioning under the administrative control of Buildings (C & M) Circle, Tirunelveli with effect from 07.09.2022. The above said building was inaugurated on 14.04.2022 and start functioning. The completion Report for the above Main Estimate was recorded on 06.08.2023 in Buildings Construction & Maintenance Division, Tirunelveli.
6. The above said Building functioning in smooth condition till date.''
5. It is thus seen that the tender notification had been issued on 13.01.2020, and the tenders were opened on 24.02.2020. The bid submitted by M/s.RSK Construction and Projects, Coimbatore, was accepted, the agreement was duly executed, the work order was issued, and the construction work has since been completed. The building has been handed over, inaugurated, and is fully functional as on date. It has also been stated in the status report that the said building continues to function smoothly.
6. Recording the status report filed and upon hearing the learned Additional Advocate General, we are of the view that no further directions are called for in this Writ Appeal. Accordingly, the Writ Appeal stands disposed of, by setting aside the directions of the learned Single Judge and approving the work entrusted to M/s.RSK Construction and acknowledging the completion of the civil works executed by them. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
