ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police in P.R.C.No.24 of 2005 on the file of the learned Judicial Magistrate, Boothapandy, seeks anticipatory bail. 2.The petitioner was absent on 28.11.
2005 during the trial in P.R.C.No.24 of 2005 before the learned Judicial Magistrate, Boothapandy. Therefore, Non-Bailable Warrant came to be issued. 3.The learned counsel appearing for the petitioner undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates without fail.
4.If the petitioner fails to appear before the Court below for future hearings, he is entitled to file appropriate petition under Section 317 Cr.P.C. Even if on one hearing, he is absent and no application is filed for condoning his absence, this order granting anticipatory bail shall stand cancelled.
5.Recording the above said undertaking given by the learned counsel appearing for the petitioner, the petitioner is permitted to appear before the trial Court on next hearing date and to file a recall warrant petition.
