9263/2022) PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondents to

conclude the proceedings in Na.Ka.No.268/2019/A4, dated 25.11.2019, pending on the file of 2nd Respondent within the time that may be stipulated by this Honble Court.

ORDER

The Writ Petition is filed, seeking a direction to the respondents to conclude the proceedings in Na.Ka.No.268/2019/A4, dated 25.11.2019, pending on the file of second respondent, within the time stipulated by this Court.

2. According to the petitioner, she got 3 Acres 19 Cents of land in Survey No.314/2 and 314/2 at Thamaraipadi Village, Dindigul East Taluk, Dindigul District, in a family arrangement, dated 09.12.1986. The petitioner's sister's son, namely, S.K.M.Abdul Rasheed fraudulently obtained pattas for the above mentioned properties, along with petitioner's share, and he settled the said property in favour of his wife, fourth respondent herein, and obtained patta in her name. Aggrieved by the same, the petitioner submitted an appeal before the second respondent, seeking cancellation of patta, issued in the

name of fourth respondent. Though proceedings were initiated by second respondent in Na.Ka.No.268/2019/A4 as early as 2019, till-date, the same have not yet been concluded and final orders passed. Hence, the petitioner has come before this Court.

The Additional Government Pleader, appearing for respondents 1 to 3, would submit that the appeal proceedings pending on the file of second respondent will be concluded and final orders will be passed in accordance with law. Though fourth respondent is unserved, since no adverse orders are passed against her in this writ petition, notice to her is dispensed with.

4. In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to conclude the proceedings pending on his file in Na.Ka.No.268/2019/A4 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of copy of this order, after issuing notice to petitioner, fourth respondent, and other interested parties.

5. Accordingly, the Writ Petition stands disposed of. No costs. 15.07.2025
