The petitioner/A1, who was arrested and remanded to judicial custody on 04.11.2024 for the offences punishable under Sections 8 (c ), 20(b) (ii) (C), 29 (1) and 25 of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.277 of 2024, on the file of the respondent police, seeks bail.

The case of the prosecution is that on 03.11.2024 at about 12.30 hours, based on the secret information received by the Sub Inspector of Police, when the police officials went near Narayanathevanpatti River Bridge, and conducted vehicle check and found the vehicle bearing Registration No.TN.60 Q 1013 Bajaj Discover, and on seeing the police party, the petitioner and other accused attempted to escape from the scene of occurrence. The police arrested the accused, from whom, they recovered the contraband of 24 Kgs of ganja. Hence the case came to be registered.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any of the offences alleged by the prosecution. He further submitted that the petitioner has been in judicial custody since 04.11.2024. It is also submitted that the 2/5
petitioner had filed earlier bail application in Crl.O.P(MD) No.4420 of 2025 and the same was withdrawn by the petitioner on 03.04.2025. This is the 2nd bail application. He further submitted that separate recoveries were made from each accused and separate athatchi were prepared; therefore, the case would not fall under the category of commercial quantity, as each accused was found in possession of different quantities. Hence, considering the period of incarceration, he sought grant of bail.
4. The learned Additional Public Prosecutor submitted that the accused were arrested along with contraband. He further submitted that the petitioner has not satisfied the requirements under Section 37 of the NDPS Act. Hence, he strongly objected to the grant of bail to the petitioner.
5. Considering the gravity of the offence and the quantity of Ganja and also considering the fact that the petitioner has failed to satisfy the requirements under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioner.
