O R D E R

The petitioner has approached this Court seeking issuance of a Writ of Mandamus directing the first respondent to dispose of the appeal filed by the petitioner on 16.03.2026.

2. Heard Mr. S. Sivaprakash, learned counsel for the petitioner, and Mr. P. Subbaraj, learned Special Government Pleader, appearing for respondents 1 and 2.

The third respondent, who is the mother of the petitioner, filed a petition under Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, seeking cancellation of the gift deed executed in favour of the petitioner, contending that the petitioner had failed to provide her with basic amenities. Pursuant thereto, the second respondent, by order dated 28.02.2023, cancelled the gift deed dated 04.04.2022. Aggrieved by the same, the petitioner filed an appeal before the first respondent on 16.03.2026. The grievance of the petitioner is that the first respondent has not taken any steps to dispose of the said appeal, 2/5

and the delay in disposal of the appeal has adversely affected her rights over the immovable property, which is the subject matter of the cancelled gift deed.

4. Mr. P. Subbaraj, learned Special Government Pleader, who accepts notice on behalf of respondents 1 and 2, upon instructions, submitted that the appeal filed by the petitioner on 16.03.2026 would be disposed of on merits within the time frame to be fixed by this Court. The said submission is taken on record.

In view of the above, this Writ Petition stands disposed of with a direction to the first respondent to dispose of the appeal filed by the petitioner dated 16.03.2026, on its own merits and pass appropriate orders in accordance with law, after affording sufficient opportunity of hearing to both the petitioner and the third respondent.

6. The aforesaid exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order. 3/5

7. There shall be no order as to costs.
