ORDER

This Criminal Original Petition is filed to transfer investigation of the case in Cr.No.105 of 2023 pending on the file of the 6th respondent police to the 5th respondent/ C.B.I officer any other independent agency under the direct supervision of the respondents 3 and 4. 2/4

2. Learned counsel for the petitioner submitted that the petitioner who is the defacto complainant in the said crime, had lodged a complaint on 16.04.2023 with respect to the death of the petitioner's son due to accidental death. Since there is no progress in the said complaint, seeking transfer of the investigation, this petition came to be filed.

3. The learned Government Advocate, on instructions, would submit that the investigation has been completed and a final report has also been filed before the Judicial Magistrate No.II, Kodaikanal, in C.C.No.82 of 2023.

4. In view of the above, this Criminal Original Petition is closed, with liberty to the petitioner to challenge the final report, by filing a petition seeking further investigation under Section 173(8) Cr.P.C., / 193

(9) BNSS, 2023, if not satisfied by the manner in which final report is filed.
