PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying this Court to direct the second and third respondents to give adequate Police protection to the life and limb of the petitioner and her family members on the basis of her representation to the respondents 1 to 3 dated 18.05.2022.

ORDER

This Criminal Original Petition has been filed to direct the second and third respondents to give adequate Police protection to the life and limb of the petitioner and her family members on the basis of her representation to the respondents 1 to 3 dated 18.05.2022.

The learned counsel for the petitioner submitted that on 27.12.2021 at about 7.30 am., when the petitioner went to her house along with her husband, the fourth and fifth respondents way laid the petitioner, abused and assaulted them and take Rs.2500 from the petitioner's bag and threatened their life. Hence the petitioner preferred a complaint against them before the second respondent Police. Since no action was taken, the petitioner filed a 1/3

petition before the Additional Mahila Court, Nagercoil (In Crl.M.P. (MD).No.43 of 2022) which was forwarded to the third respondent under Section 156(3) of Cr.P.C. Thereafter, the third respondent registered a case against the fourth and fifth respondents in Crime No.131 of 2022 for offences under Section 341, 294(b), 323, 379, 506 (I) of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002. After registering the case, the fourth and fifth respondents threatening the petitioner.

3. The learned Government Advocate (Criminal Side) submitted that the fourth and fifth respondents are the brother and brother's wife of the petitioner. Both are close relatives to the petitioner and hence the case is registered against them on the complaint given by the petitioner.

4. I have considered the matter in the light of the submissions made by the learned counsels for both the parties.

5. Admittedly, it is not the dispute. The petitioner and the fourth and fifth respondents are relatives and the fourth respondent is the brother of the petitioner and the fifth respondent is the wife of the fourth respondent. With regard to the occurrence on 27.12.2021, a case has been registered in Crime No.131 of 2022. The case is under investigation. Meanwhile, being threatened by the fourth and fifth respondents, the petitioner gave a representation to the third respondent seeking protection on 18.05.2022.

6. In view of the above, this Court directs the second and third respondents Police to consider the representation dated 18.05.2022 given by the petitioner and take appropriate action in the matter.

7. With the above direction, this Criminal Original Petition is disposed of.
