PRAYER:- Writ Petition - filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondents to proceed further with the "option form" and application dated 11.11.2013 submitted by the petitioner and revise the scale of pay for availing the monetary pension benefits under G.O.Ms.No.363, Finance (PGC) Department dated 23.08.2013. O R D E R

The petitioner was 82 years, when the writ petition was filed in July 2019. He superannuated on 31.10.1995 as Office Assistant at Agastheeswaram Taluk, Kanniaykumari District and he has been receiving pension. He takes benefit of G.O.Ms.No.363, Finance [PGC] Department dated 23.08.2013, ordering revision of pension of those retirees between 01.06.1988 to 31.12.1995, with reference to prerevised scale of pay (i.e.,) prior to 01.06.1988. He has filed an application along with Option Form on 11.11.2013, seeking the benefit of revision of pay of pension, but, is yet to receive the benefits as claimed.

Though there is some delay in filing the application itself, MrA.K.Manikkam, learned Special Government Pleader would not very seriously object to this Court directing the respondents to process the application dated 11.11.2013 and the detailed representation of the petitioner dated 13.03.2017. Thus, a direction is issued to R2/Tahsildar to process the application dated 11.11.2013 and pass necessary orders within a period of four weeks from today. https://hcservices.ecourts.gov.in/hcservices/ 1/2
