O R D E R

This Writ Petition has been filed to direct the 2nd Respondent to issue a No-Objection Certificate to the petitioner to run a Ayurvedic Massage Centre in the name and style of Agathiyar Ayurvedic Massage Centre, running business at D.No.c-73, 4th Cross Street, Thillai Nagar, Tirchy town, Tirchy on the basis of the petitioner's representation dated 12.04.2025.

2.According to the petitioner, he is running a Ayurvedic Massage Centre in the name and style of Agathiyar Ayurvedic Massage Centre, D.No.C-73, 4th Cross Street, Thillai Nagar, Tirchy town, Tirchy with qualified staff in Kerala Ayurvedha by following all rules and regulations. While so, the 2nd respondent came to the Centre and insisted him to show no-objection certificate to run the Centre. In this regard, he has sent a representation on 12.04.2025, but the same was not considered. Hence, this petition.

3.The learned Additional Public Prosecutor appearing for the respondent police would submit that they have already considered the representation of the petitioner and the 1st respondent has passed an order, dated 17.04.2025 stating that license has to be granted only by Commissioner of Corporation. Therefore, the petitioner was advised to approach the Commissioner of Corporation. However, the petitioner has sought only for no-objection certificate, it has to be issued by the respondent police, thereafter, the Commissioner of Corporation will consider the representation of the petitioner. Therefore, if the petitioner appears with relevant documents before the respondent police, they will consider and take appropriate action.

4.Considering the prayer sought for by the petitioner and the respondent also admitted that so far, no-objection certificate is not issued, this Court hereby directs the petitioner to appear before the 1st respondent police on 30.04.2025 and produce all the relevant records, thereafter, 1st respondent is directed to consider the representation of the petitioner and act in accordance with law within a period of 15 days week from the date of this order.

5.With the above observations and direction, this Writ Petition is disposed of.
