ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents 2 to 4 to cancel the Kist receipts issued in favour of the respondents 5 and 9 in the year of 2021 and 2022 and consequently, to direct to the respondents 2 to 4 to issue the Kist receipts in the petitioner's name as per the

earlier Kist receipts issued by the respondents 2 to 4, by considering petitioner's representation dated 04.01.2023.

2. Heard the learned counsel appearing for the parties.

According to the petitioner, Kist receipts were issued in favour of the respondents 5 and 9 for the years 2021 and 2022, although they have no lawful entitlement to have their names recorded for the said property. The petitioner states that prior to 2021, the Kist receipts were consistently issued in his name by the respondents 2 to 4, thereby recognising the petitioner's possession and enjoyment of the property. The sudden issuance of Kist receipts in favour of the respondents 5 and 9 for the years 2021 and 2022 is arbitrary, illegal, and contrary to the earlier revenue records, causing prejudice to the petitioner.

The petitioner submitted a representation dated 04.01.2023 to the respondents 3 and 4, seeking cancellation of the Kist receipts issued in favour of the respondents 5 and 9, and requesting restoration of the petitioner's name in the Kist receipts, but no action has been taken. Hence, the present Writ Petition.

5. The learned Government Advocate for the respondents 1 to 4 submits that the petitioner's representations will be considered on its merits and in accordance with law.

Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the respondents 3 and 4 to consider the petitioner's representation dated 04.01.2023, on merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry. The respondents 3 and 4 are directed to provide reasonable opportunity during such enquiry to the petitioner and also to the other persons, who may be affected by such decision. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
