PRAYER : Criminal Original Petition is filed under Section 439(1)(B) of Cr.P.C, to set aside the order in Vacation Cr.M.P.No.122 of 2024 in Cr.M.P.No.1805 of 2024 dated 10.05.2024 on the file of the I Additional District Judge (PCR), Vacation Sessions Judge, Trichy and set aside the same and relax the condition in toto.

O RDER This criminal original petition has been filed to set aside the order in Vacation Cr.M.P.No.122 of 2024 in Cr.M.P.No.1805 of 2024 dated 10.05.2024 on the file of the I Additional District Judge (PCR), Vacation Sessions Judge, Trichy and relax the condition in toto.
2.By the order dated 25.04.2024, the Principal District and Sessions Judge, Trichy, granted anticipatory bail to the petitioners in Cr.M.P.No.1805 of 2024. While granting anticipatory bail, condition was imposed upon the petitioners to appear before the respondent police daily at 07.00 p.m. until further orders. Against which, the petitioners moved Cr.M.P.No.122 of 2024 before the Vacation Court, Trichy. The same was disposed of modifying the above said condition directing the petitioners to appear before the respondent police on every Monday at 07.00 p.m.
3.To set aside the above said order and to relax the condition the petitioners has come forward before this Court on the ground that the petitioners are aged about 73 years and 70 years respectively. They are facing numerous ailments. 2/5
Without any assistance they cannot travel and already the matter was enquired by the Inspector of Police as well as the District Social Welfare Officer in various occasions. So the presence of the petitioners are not necessary to them. 4.Considering the age of the petitioners, this Court is inclined to allow this petition. Accordingly, this criminal original petition stands allowed and the condition imposed upon the petitioners is relaxed and the petitioners are directed to appear before the respondent police as and when required.
