To Suspend the sentence imposed on the petitioner by the learned II Additional District and Sessions Judge, Thoothukudi, Thoothukudi District, in S.C.No.351 of 2023 by the judgment dated 14.11.2025 and enlarge the petitioners on bail pending disposal of the appeal.
ORDER
(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed seeking suspension of sentence of imprisonment imposed on the petitioners by the learned II Additional District and Sessions Judge, Thoothukudi, Thoothukudi District, in S.C.No.351 of 2023, dated 14.11.2025, to enlarge the petitioners on bail.
2. The case of the prosecution is that there was a drunken brawl between the deceased Murugan and A1 to A4 and hence, there was animosity between the parties. On 18.03.2023 at about 4.45 p.m., when the deceased was proceeding to his house, he is said to have been wrongfully restrained by the accused persons and he was abused in filthy language and there was a wordy quarrel, as a result of which, the deceased was said to have been attacked with stone repeatedly. The deceased succumbed to the injuries on 19.03.2023. It is under these circumstances, the accused persons underwent trial before the learned II Additional District and Sessions Judge, Thoothukudi. There are totally four accused persons in this case and the petitioners are A2 to A4.
3. The Trial Court, on considering the facts and circumstances of the case and on appreciation of oral and documentary evidence, came to the conclusion that the prosecution has proved the case beyond reasonable doubt. Accordingly, convicted and sentenced the petitioners in the following manner:
Provision under which Sentence convicted Sec.294(b) of IPC Three months Simple Imprisonment Section 341 of IPC One month Simple Imprisonment Section 302 r/w. 109 of IPC Life Imprisonment and to pay a fine of Rs.5,000/-, in default to undergo six months Simple Imprisonment The above sentences were ordered to run concurrently. Aggreived by the same, the appeal has been filed along with this petition.
4. Heard the learned counsel for the petitioners and the learned Counsel for State of TN (Crl.Side) appearing for the respondent.

Taking into consideration the facts and circumstances of the case and considering the manner, in which the entire incident had taken place, pursuant to the quarrel between the accused persons and the deceased and also considering the fact that there are no previous cases against the petitioners and they have suffered incarceration from November 2025 onwards and there are arguable points in the present appeal and it will take some more time for this Court to take up the appeal for final hearing, hence, this Court is inclined to grant suspension of sentence by suspending the sentence imposed on the petitioners. Accordingly, this petition is allowed subject to the following conditions:
i. The petitioners are directed to be enlarged on bail on executing a bond for Rs.10,000/- (Rupees Ten thousand only) each with two sureties, each for a like sum to the satisfaction of the learned II Additional District and Sessions Judge, Thoothukudi, Thoothukudi District.
ii. The sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Trial Court may obtain a copy of their Aadhar card or Bank passbook to ensure their identity. iii. The petitioners shall appear and sign before the trial Court at 10.30 a.m., on the first working day of every English calender month, till the disposal of the Criminal Appeal.
