PRAYER :- For Bail in Cr.No.101/2022 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/A1, who was arrested on 25.05.2022 for the alleged offence under Sections 3(1), 4(2)(c), 5(1)(a), 7(2)(c) of Immoral Traffic (Prevention) Act, 1956, in Crime No.101 of 2022 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner along with other accused indulged in immoral activities in their premises. 3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is the lease holder of the lodge and he has no knowledge about the said occurrence and he would further submit that the petitioner is in judicial custody from 25.05.2022.
4.The Investigating Officer/defacto complainant is present before this Court. She would submit that on 25.05.2022, when she and her officials made a routine check up at Ram lodge at Palani, at that time they found a girl from Kerla and enquired her. Thereafter, she revealed that petitioner along with other accused/A2 involved her in prostituition business. CRL OP(MD). No.10562 of 2022 5.The learned Government Advocate(Crl.side) appearing for the respondent police fairly admits the submission of the Investigating Officer.
6.Considering the facts and circumstances of this case, the petitioner is not having any bad antecedents and the period of incarceration, this Court is inclined to grant bail to the petitioner with certain conditions.
7.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Palani, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
