PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the respondents to complete the investigation in Crime No.201 of 2017 dated 10.07.2017 and to file final report within the time frame as fixed by this Court. For Petitioner : Mr.Aayiram K.Selvakumar For Respondents : Mr.R.M.Anbunithi Additional Public Prosecutor.

ORDER

This petition has been filed seeking a direction to the respondents to complete the investigation in Crime No.201 of 2017 dated 10.07.2017 and to file final report within the time frame as fixed by this Court.

2. The grievance of the petitioner is that a specific direction has been issued by this Court in Crl.O.P.(MD).No.3821 of 2019 dated 13.03.2021. While transferring the case, this Court issued another direction to the third respondent to cause a proper investigation of the case. In pursuance thereof, investigation has been transferred to the third respondent herein. According to the learned counsel for the petitioner, after transfer, there is no

progress even though he appeared before the third respondent for several times.

3. The Additional Public Prosecutor submits that the accused in this case are residing in North India and the petitioner has not shared information about the whereabouts and as well as the documentary evidence which are available with him in connection with the occurrence.

4. Even though the learned counsel for the petitioner submits that the petitioner has appeared before the Enquiry Officer several times but in spite of that there is no progress, the learned Additional Public Prosecutor submits that so far 50 witnesses have been examined and he requests five months time to complete the investigation and file a final report.

5. Considering the oldness of the matter as well as the fact that the accused are North Indians, this Court grants five months time to the second respondent to complete the investigation and file a final report before the concerned court. After filing a final report, compliance report shall be sent to the Registry.

6. With the above direction, this Criminal Original Petition is disposed of.
