PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying this Court to direct the respondent to conduct a fair and speedy investigation and file a final report in Crime No.2 of 2022 on the file of the respondent within the time stipulated by this Court.

ORDER

This Criminal Original Petition has been filed to direct the respondent to conduct a fair and speedy investigation and file a final report in Crime No.2 of 2022 on the file of the respondent.

2. The facts of the case are that the petitioner was cheated by the accused assuring him to provide job to the petitioner's son on payment of Rs.5,00,000/-. In this regard, the petitioner paid Rs.3,00,000/- in advance by handing over all necessary documents of his son to the accused. Thereafter, the accused did not return the money and cheated the petitioner. Hence the petitioner preferred a complaint before the respondent Police and FIR was registered in Crime No. 2 of 2022 for offences under Sections 403, 406 and 420 of IPC.

3. The learned counsel for the petitioner submitted that the case has been registered against the accused and the respondent Police has not completed the investigation and filed a final report till date. Hence, the present Criminal Original Petition has been filed.

The learned Government Advocate(Criminal Side) submitted that the respondent Police seeks two months time to complete the investigation and file the final report. https://hcservices.ecourts.gov.in/hcservices/ 1/2

5. I have considered the matter in the light of the submission made by the learned counsel for both the parties. By accepting the submission of the learned Government Advocate, two months time have been granted for completing the investigation and this Court directs the respondent to file a final report before the concerned learned Judicial Magistrate.

6. With the above direction, this Criminal Original Petition is disposed of.
