O R D E R

This petition is filed by the petitioner to direct the respondents 1 to 4 consider the petitioner's representation dated 22.03.2025 and take suitable action against the erring police official of Keeranur police station and the persons, who cut and transported the Karuvelam trees illegally from the petitioner's land situated in S.F.Nos.74/4, 74/5, 75/3, 78/4, 79/1, 79/3, 80/1, 80/3, 81, 82/1, 82/2, 83, 84, 86, 87, 88/1A, 89/1A, 90, 110/2 in Mellakaraipatti revenue Village, Palani Taluk, Dindigul District and thereby, recover the wooden logs worth to a tune of Rs.40,00,000/-. The learned counsel for the petitioner would submit that the petitioner is one of the shareholder for the property in S.F.Nos.74/4, 74/5, 75/3, 78/4, 79/1, 79/3, 80/1, 80/3, 81, 82/1, 82/2, 83, 84, 86, 87, 88/1A, 89/1A, 90, 110/2 in Mellakaraipatti revenue Village, Palani Taluk, Dindigul District. While so, the petitioner decided to clean the property and remove the Karuvelam trees. However, the Police Officials stopped the petitioner from entering into the property and cutting trees in patta land. The fifth respondent/Keeranur Police station along with the third respondent gave protection to the ruling party persons, who entered into the petitioner's land with more than 7 JCB and Hitachi vehicles and started to cut the Karuvalam trees illegally and also transported the same in the lorry.

When the same was questioned by the petitioner, the police officials threatened the petitioner and others. Therefore, she sent representations dated 29.01.2025 and 30.01.2025 to the respondents 1 to 3, but no action was taken. However, the second respondent through order dated 19.03.2025 directed the petitioner to get remedy by approaching jurisdictional police station. Thereafter, she sent a representation dated 22.03.2025 to take suitable action against the above persons, but no action was taken. Therefore, she filed this petition. Page No.

3. The learned Government Advocate for the respondents 1 to 3 would submit that they received the complaint from CM cell, sent by the petitioner and the same was enquired. During the enquiry, they came to know that the abovesaid properties are patta lands belong to the petitioner and others and there is a dispute between the joint owners. To that effect, they also passed orders dated 07.02.2025 and 19.02.2025.

4. The learned Additional Public Prosecutor (Crl.Side) for the respondents 4 and 5 would submit that the representation of the petitioner is under enquiry. They will conduct enquiry and take appropriate action in accordance with law.

5. The representation of the petitioner was already considered by the respondents 1 to 3 and they also passed order by observing that the properties are patta lands and not Government poramboke land. As far as the respondents 4 and 5 are concerned, the representation of the petitioner is under consideration. Therefore, this Court directs the Deputy Superintendent of Police, Palani, to conduct enquiry on the petitioner's representation dated 22.03.2025 and take appropriate action in accordance with law, after affording opportunity to both the parties within a period of Page No. 4 of 6

one month from the date of this order.

6. With the abovesaid observations and directions, this Writ Petition is disposed of. No costs.
