Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents more specifically, the 4th respondent and 5th respondents to consider the petitioners application dated 08/11/2018 and 21/12/2018 and survey the punja land in respect of 28 1/4 cent (sketch appended) in survey No.444/23 measuring 57 meters on the North, 58.4 meters in South, 23.2 meters in East and 18.6 meters in West situated in Poonaampalayam Village, Mannachanallur Taluk, Trichy District by following due process of law within a time limit to be fixed by this Court.

ORDER

The writ petitioner is no more.

2. The learned counsel for the petitioner states that the writ petitioner died a bachelor without leaving behind any issue. According to the petitioner's counsel, the petitioner's sister is the only surviving legal heir.

3. But it is contested by the learned counsel for the 6th respondent. According to the learned counsel for the 6th respondent, 6th respondent is the 2/4

wife of the petitioner.

4. In writ proceedings, such contested matters cannot be gone into. Leaving open the rights of the parties, the writ petition is closed as abated. No costs.
