Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus any other writ or order or direction in the nature of writ, directing the second respondent to accommodate the petitioner in the third respondent Teacher Training Institute or any other Government Teacher Training Institutes to undergo the course of Diploma in Teacher training in pursuance of the order passed by the Division Bench vide W.P.No.953/2004 dated 04.03.2004 and W.P.No.43047/2006 dated 09.11.2006.

JUDGMENT

(Judgment of this Court was delivered by S.MANIKUMAR, J.) Challenge in this appeal is to an order, dated 04.01.2013, made in W.P.(MD)No.8552 of 2010, by which, the writ Court has issued a Mandamus directing the Director of Teacher Education Research and Training, Chennai to accommodate the respondent/writ petitioner in Government Teacher Training Institute, T.Kallupatti, Madurai District, the appellant No.3 so as to enable the respondent/writ petitioner to complete the diploma course, pursuant to the order of the Hon'ble Division Bench of this Court in W.P.No.953 of 2004, dated 04.03.2004.

2.Though State of Tamil Nadu represented by the Secretary to the Government, Education Department, Chennai and two others have filed the instant appeal with a delay of 87 days, Mr.D.Shanmugaraja Sethupathi, learned counsel appearing for the respondent submitted that pursuant to the directions issued in W.P.(MD)No.8552 of 2010, dated 04.01.2013, the respondent has been accommodated the Government Teacher Training Institute, T.Kallupatti, Madurai District, undergone the course, issued with a certificate and also registered the same, with the employment exchange.

3.Submission of the learned counsel appearing for the respondent is placed on record.

4.Inasmuch as the order impugned in the instant appeal had already been complied with, no useful purpose would be served in entertaining the appeal. Accordingly, the writ appeal is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
