Respondents PRAYER : Writ petition filed under Article 226 of the Constitution of India to issue a writ of Mandamus, directing the respondents to sanction the Conveyance Allowance of Rs.2500/- per month as per the G.O.M.S.No.307 dated 13.10.2017 and arrears of Conveyance Allowance from 01.10.2017 payable to the Petitioner along with reasonable rate of interest within the time that may be stipulated by this Court. Heard the learned counsel for the petitioner, the learned Government Advocate appearing for the respondents 1 to 3 and the learned Standing counsel appearing for the respondents 4 and 5. 2.The petitioner herein claims sanction of conveyance allowance of Rs.2,500/- per month as per the G.O.M.S.No.307, Finance (Pay Cell) Department, dated 13.10.2017. On the side of the petitioner, it was submitted that pending writ petition, the respondents herein had paid the conveyance allowance only with effect from 01.10.2020 and now the petitioner has retired from the service. The petitioner claims that as per the aforesaid G.O.M.S.No.307, dated 13.10.2017, he is entitled for conveyance allowance from 01.10.2017. 3.
In this regard the petitioner is at liberty to give a fresh representation to the respondents claiming such conveyance allowance and on receipt of the same, the fifth respondent shall consider the same in the light of G.O.M.S.No.307 dated 13.10.2017 and pass appropriate orders, within a period of four weeks from the date of receipt of such fresh representation from the petitioner. 4.With the aforesaid directions, this writ petition stands disposed of. No costs.
