PRAYER : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the fifth respondent to issue a letter of recommendation / No objection to carry on quarrying operations at S.No.450/3 to an extent of 1.21.5 Hectares Periyamanjuveli Village, Aravakurichi Taluk, Karur District, to the petitioner on the basis of the representation of the petitioner dated 06.04.2023 and the communication of the fourth respondent in his proceedings in Na.Ka.No.532/2020, dated 14.03.2023. 2. The Writ Petition has been filed in the nature of a Mandamus seeking a direction particularly, against the fifth respondent/Panchayat President, Periya Manjuveli Village, Karur District, to examine the request of the petitioner to issue a letter of recommendation / No Objection to carry out quarrying operations at lands in Survey No.450/3 measuring 1.21.5 Hectares at Periyamanjuveli Village, Aravakurichi Taluk, Karur District. The Petitioner had given a representation on 06.04.2023.

3. The petitioner sought to conduct quarrying operation of small stones and in this connection, had obtained necessary clearances from the respondents 1 to 3. The fourth respondent had directed "No Objection Certificate" to be obtained from the fifth respondent. The petitioner had given a representation.

4. Since the issue is under the purview of the fifth respondent, a direction is given to the fifth respondent to issue notice to the petitioner herein and determine whether there are any objections from any of the other adjacent land owners or villagers and thereafter, 3/6

take a considered decision whether to grant "No Objection Certificate" or not to grant "No Objection Certificate". If a decision is taken not to grant "No Objection Certificate", then necessary reasons must be given. At any rate, the entire exercise must be completed within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above directions, the Writ petition stands disposed of. No costs.
