The writ petition is filed seeking a direction to the respondents to consider the petitioner's claim for grant of patta in respect of the land situate in S.No.10, Mandapam Revenue Village, Ramanathapuram Taluk, Ramanathapuram District and also further restraining the respondents from interfering with the peaceful possession of the petitioner. 2.According to the petitioner, he has been in possession and enjoyment of the subject property with an extent of 2 acres 71 cents for the past four decades. The petitioner submitted an application before the first respondent on 26.03.1979 for issuance of patta on the ground that 2/5

he is an ex-service man. But the same is under consideration till date. In the mean time, the respondents attempted to interfere with the possession of the petitioner. Hence, the instant writ petition has been filed.

3.The learned Additional Government Pleader appearing for the respondents bring it to the notice of this Court that the petitioner filed a civil suit in O.S.No.54 of 2023 before the Sub Court, Ramanathapuram seeking the very same relief.

4.A perusal of the affidavit and typed set of papers would indicate that the petitioner already laid a civil suit seeking injunction restraining the respondents 1 to 3 from interfering with his possession over the subject property. In such circumstances, the petitioner is not entitled to maintain a writ petition for similar relief. As far as the first limb of the prayer in the writ petition is concerned, it is open to the petitioner to submit a fresh representation before the first respondent seeking issuance of patta on the ground that he is an ex-service man. 3/5

5.With the above direction, this writ petition stands disposed of. No costs.
