PRAYER :- For bail in Crime No.7 of 2025 on the file of the respondent-police. ORDER : The Court made the following order :- This Criminal Original Petition has been filed by the petitioner on 22.04.2025 under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) praying to grant bail.

2. The petitioner / sole accused was arrested and remanded to judicial custody on 08.04.2025 for the alleged offences punishable under Section 12 read with Section 11(1) of Protection of Children from Sexual Offences Act, 2012 in Crime No.7 of 2025 on the file of the respondent-police.

3. The case of the prosecution is that the petitioner tortured the minor school going girl, by asking for her cell phone number on the way to her School. Hence the case.

4. Mr.P.Edin Brough, the learned counsel appearing for the petitioner submits that the petitioner did not commit any offence as alleged by the prosecution and that a false case has been foisted against him. He further submits that the petitioner has been in judicial custody since 08.04.2025. He however submits that the petitioner is ready to abide by any condition to be imposed by this Court. He therefore prays to grant bail to the petitioner.

5. Mr.K.Sanjai Gandhi, learned Government Advocate (Crl. Side) appearing for the respondent-police, submits that the investigation is in initial stage and prays to dismiss this Criminal Original Petition.

6. Heard on both sides. This Court has perused the records including the First Information Report and the statement of victim girl.

7. The petitioner was arrested on 08.04.2025 and is in judicial custody. Investigation is in nascent stage. In view of the offence allegedly committed by the petitioner, if bail is granted to him at this stage, he may cause threat to the victim girl and witnesses and may abscond and thereby delay the investigation. In view of the same, this Court is not inclined to grant bail to the petitioner at this stage. 3/4
