PRAYER :- For Interstate Anticipatory Bail in Cr.No.797 of 2024 on the file of the first respondent police.
ORDER : The Court made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 316(5), 319(2), 318(4), 3(5), 61(2) of BNS and Section 66-D of Information Technology Act , in Crime No.797 of 2024 on the file of the respondent police, seeks interstate anticipatory bail.

The case of the prosecution is that on 01.05.2024 the defacto complainant received a whatsapp call from an unknown individual namely Meera Patel, at that time she introduced herself as an agent representing a trading company and inquired whether the defacto complainant was interested in trading. Thereafter she shared a link with the defacto complainant and invited him to join a whatsapp group named ' Alankit Limited Trend Learning Group D1' . The defacto complainant also joined the group and started receiving regular information about trading. Thereafter the defacto complainant was added to another whatsapp group named 'SG-103 SMC Global', through a different number and through that 2/6
group advanced trading stratgies and investment advice and at that time a woman named Ayushi Pokhriyal contacted the defacto complainant and shared a link to download the SMC app. She guided the defacto complainant to register on the app by providing personal details such as bank account number, Aadhaar number, PAN number and mobile number and thereafter the defacto complainant was instructed to invest Rs.10,000/- and as instructed by Ayushi . Thereafter the defacto complainant yielded a profit of Rs.2883/- and thereafter invested Rs.4,60,008/- as instructed by Ayushi. Thereafter the defacto complainant invested Rs.1,99,42,434/- and when the defacto complainant attempted to withdraw Rs.20,00,000/- from his account on the Alankit app he was unable to withdraw the amount .
When the defacto complainant contacted Meerapatel to address the issue she assured that the matter would be resolved after consulting the management. Later on the same day evening Meera patel informed the defacto complainant that he must deposit an additional Rs.20,00,000/-and demanded the defacto complainant to invest the amount otherwise the amount would be confiscated, thereafter the defacto complainant realized the cheating by the said persons. Hence the case.
3. Learned counsel appearing for the petitioner would submit that the petitioner has nothing to do with the aforesaid alleged offence and a false case has been foisted against him. There is no specific role played by the petitioner. The petitioner is now taking steps to file anticipatory bail before the Court at Pune. Hence, prayed to grant inter state anticipatory bail to the petitioner.
4. Though notice served to the 1st respondent, there is no representation. The learned Government Advocate appearing for the 2nd objected to grant anticipatory bail.

Taking into consideration the facts and circumstances of the case, considering the nature of offences and the petitioner has to take steps for bail and he has to go to Pune, this Court is inclined to grant inter-state interim anticipatory bail to the petitioner for a period of six weeks to enable him to move the concerned Court.
6. Accordingly, interim interstate anticipatory bail is granted to the petitioner for a period of six weeks, on condition that the petitioners shall surrender before the learned Judicial Magistrate No.II, Pudukottai, 4/6
within a period of fifteen days from the date on which the order copy is made ready and the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within four weeks from the date of execution of bail bond, the petitioner shall approach the competent Court and seek appropriate relief.
