PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying this Court to direct the second respondent to file a final report in Crime No.325 of 2016 dated 04.04.2016 on the file of the second respondent within a time period stipulated by this Court. ORDER

This Criminal Original Petition has been filed to direct the second respondent to file a final report in Crime No.325 of 2016 dated 04.04.2016 on the file of the second respondent.

2. The facts of the case are that there was a quarrel between the petitioner and the four other persons. In this regard, F.I.Rs were registered in Crime No.324 of 2016 and Crime No.325 of 2016. The respondent Police filed a final report in Crime No.324 of 2016 before the Judicial Magistrate No.1, Karur District and the same was taken on file in C.C.No.156 of 2016. But the respondent Police did not file a final report in Crime No.325 of 2016 till date. Hence, the Criminal Original Petition has been filed.

3. When the matter was taken up for hearing, the learned Government Advocate (Criminal Side) submitted that the complaint has been enquired by the respondent Police. After investigation, the respondent Police found that there is no cognizable offence made out in the case and the case has been closed as mistake of fact and a https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD) No.10590 of 2022 final report has been sent to the Judicial Magistrate-I, Karur District.

4. I have considered the matter in the light of the submission made by the learned counsel for both the parties.

5. By considering the submission of the learned Government Advocate (Criminal Side), this Petition is closed and the petitioner may take appropriate legal action in this matter.

6. With the above observation, this Criminal Original Petition is closed.
