Respondents Prayer :Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus, to direct the respondents to secure and produce the body or person of the detenue namely Hemalatha, W/o.Maruthupandi, aged about 30 years and female children namely Yalini, D/o.Maruthupandi, aged about 10 years, before this Court and set him at liberty.

ORDER

(Order of the Court was made by N.ANAND VENKATESH,J.) This Habeas Corpus Petition has been filed for a direction to the respondents to secure and produce the body or person of the petitioner's wife and to set her at liberty.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondents.

3. The petitioner was married to the detenue 11 years back and they were blessed with two children. Earlier, the detenue went missing along with the son and hence, a complaint was given before the second respondent, based on which, a ''woman missing'' FIR was registered in Crime No.45 of 2026. Subsequently, the detenue was secured along with the son and hence, the said FIR was closed. Thereafter, once again, on 08.03.2026, the detenue went missing along with the daughter. In spite of

best efforts, her whereabouts could not be ascertained. Hence, yet another complaint was given before the second respondent and the same was taken on file in CSR.No.303 of 2026. Since no effective steps were taken to find the whereabouts of the detenue and the daughter, the present petition has been filed before this Court.

4. Taking into consideration the facts and circumstances of the case and the submissions made on either side, there shall be a direction to the second respondent to register a woman missing FIR and find the whereabouts of the detenue and the daughter and they shall be produced before the learned Judicial Magistrate, Natham. The petitioner shall be put on notice at the time of their production. The learned Magistrate shall record the statement of the detenue and proceed further in accordance with law.
