PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent namely the Commissioner of Madurai Corporation, to forthwith remove the garbage and drainage waste materials and other obstructions dumped 1/6
in the common pathway situated at the back side of C.S.I.Church at American Mission Church Street, Madurai-625 001 by considering the petitioner representation dated 25.03.2026.

ORDER
(Order of the Court was made by N.SATHISH KUMAR, J.) This writ petition has been filed seeking a direction to the second respondent to remove the garbage and drainage waste materials and other obstructions dumped in the common pathway situated at the back side of CSI Church at Americal Mission Church Street, Madurai-625 001.
2.Mr.A.Kannan, learned Additional Government Pleader, accepts notice for the first and fourth respondents and Mr.K.K.Kannan, learned Standing Counsel, accepts notice for the second and third respondents.

3.By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself. 4.When the matter was taken up for hearing in the morning session, the learned Standing Counsel, appearing for the respondents 2 and 3, on instructions, submitted that the drainage waste materials have been removed. He has also produced the photographs to substantiate his submission.
5.However, the learned counsel for the petitioner sought time to verify the said contention. Thereby, the matter was passed over to afternoon session.
6.When the case was taken up for hearing in the afternoon session, the learned counsel for the petitioner while conceding with the submission made by the learned Standing Counsel, submits that some debris are yet to be removed from the place in question. 3/6
7.By way of reply, the learned Standing Counsel for the respondents submits that clearing of the debris is underway and the same will be completed as soon as possible.
8.Accordingly, the second respondent is directed to clear the remaining debris and establish a permanent collection point. 9.With the above direction, this writ petition is disposed of. There shall be no order as to costs.
