Writ Petition is filed under article 226 of the Constitution of India, praying to issue a Writ of Mandamus, to direct the respondents 1 and 2 to take action against the 3rd and 4respondent Jamath authorities for their illegal and discriminatory conduct and consequently direct the respondents to ensure that the petitioner's Jamath head Tax/contribution is received and that the petitioner is treated equally with other members of the Jamath and performs religious services of the petitioner's family without discrimination.

ORDER

This writ petition is filed for a mandamus directing the respondents 1 and 2 to take action against the respondents 3 and 4 for their illegal and discriminatory conduct and consequently direct them to ensure that the petitioner's contribution is received for the Jamath and the petitioner is treated equally as any other member of the Jamath to perform all the religious services of the petitioner's family without discrimination.

2.Upon hearing the learned counsel for the petitioner, and perusing material records of the case, the claim of the petitioner is that

the petitioner and his family members are the members of Mohaideen Andavar Pallivasal Sunnathul Jamath Ujampatti, Annachi Post, Then District. However, recently the President and Secretary of the Jamath have refused to receive the head tax from the petitioner's family and had arbitrarily excluded them from the affairs of the Jamath. In this regard, the petitioner has made a representation to the first respondent Waqf Board on 13.02.2026.

3.I have heard the learned counsel appearing on behalf of the respondents 1 to 3.

4.In view of the nature of relief that is being granted, the writ petition is disposed of at the admission stage without notice to the respondents 3 and 4. The representation of the petitioner shall be taken up by the Chief Executive Officer, Tamil Nadu Waqf Board, Chennai for consideration. Notice to the petitioner as well as the respondent 3 and 4 shall be issued and after conducting due enquiry, orders in accordance with the law shall be passed. The aforesaid exercise shall be completed as expeditiously as possible in any event not later than four months from

the date of receipt of the web copy of the order. No costs. 5.Since there is a mistake in the description of the first respondent, the bundle is handed over to the petitioner for correction in the open Court. They learned counsel had made the corrections and handed over the bundle back. Registry is directed to carry out the aforesaid corrections in the cause list.
