For Petitioner : Mr.N.Sathish Babu, For Respondents : Mr.S.Deenadhayalan Standing Counsel
ORDER
Heard Ms. Saranya, learned counsel appearing for the petitioner, and Mr. S. Deenadhayalan, learned Standing Counsel appearing for the respondents.
2. The petitioner is before this Court seeking issuance of a Writ of Mandamus directing the respondents to provide electricity service connection to the building situated in Survey No.390/3B2A, measuring an extent of 0.13.03 Ares, bearing Door No.3/192, Pudukampatti, Pudhur Village, Reddiapatti Firka, Natham Taluk, Dindigul District, by considering the petitioner's representation dated 19.01.2026.
3. The case of the petitioner is that he is the purchaser of the aforesaid property and had initially obtained a temporary electricity service connection for the purpose of constructing a farmhouse. Upon 2/6
completion of the construction, the petitioner submitted an application seeking a permanent electricity service connection for the said farmhouse. However, the respondents have not processed the application on the ground that the petitioner's vendor had allegedly committed theft of electricity in respect of another service connection situated in an adjacent property.
4. It is not in dispute that no allegation of theft of electricity has been made either against the petitioner or in respect of the temporary electricity service connection granted to him. The alleged theft pertains to a different service connection located in an adjacent property and has no nexus whatsoever with the petitioner's application for a permanent electricity service connection. Therefore, the alleged violation committed in respect of another service connection cannot constitute a valid ground for denying consideration of the petitioner's application.
5. In such circumstances, this Court is of the view that there is no legal impediment for the respondents to provide a permanent electricity service connection to the petitioner's dwelling house, subject to the 3/6
petitioner satisfying all other statutory requirements and conditions prescribed under the relevant regulations.
6. Accordingly, this writ petition is disposed of with a direction to the respondents to process the petitioner's application and provide a new permanent electricity service connection to the petitioner's property, subject to the petitioner fulfilling all other applicable requirements.
7. The aforesaid exercise shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order.
8. There shall be no order as to costs.
