ORDER

This writ petition is filed challenging the impugned refusal check slip dated 26.02.2026.

2.When the petitioner presented a sale agreement claiming ownership of the property through a registered partition deed dated 23.11.2020, The sale agreement which was presented on 26.02.2026 was refused. The refusal is on the ground that a part of the said property of about 29 cents have been dealt with by one Pitchammal by way of a sale deed executed in favour of Chandrasekar vide Document No.835 of 2021. It is the claim of the petitioner that the said Pitchammal is a relative of the petitioner, but however, she does not have any right title or interest in respect of the said property.

3.I have also heard the learned Additional Government Pleader for the respondents.

4.When the petitioner is claiming title through a partition deed dated 23.11.2020 which is prior in point of time and Patta is also mutated in the

name of the petitioner by virtue of a subsequent document further exercise of right cannot be curtailed. However, since the said Pitchammal and Chandrasekar are not parties in the writ petition, positive orders cannot be passed straight away and the writ petition is allowed on the following terms: (i)The impugned refusal check slip dated 26.02.2026 shall stand set aside. The matter is remanded back to the file of the second respondent. (ii)The second respondent shall issue notice to the petitioner, the said Pitchammal and Chandrasekar and after conducting an inquiry pass further orders by taking into account the above observations made by this Court. The writ petition ordered accordingly.

(iii)The aforesaid exercise shall be completed within a period of six weeks from the date of receipt of the a copy of the order. (iv)No costs.
