For Respondent : Mr.B.THANGA ARAVINDH, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.31/2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioners are facing charges under Sections 294(b), 323, 506(i) and 109 I.P.C. in Crime No.31 of 2022 on the file of the respondent police.

2.The case of the prosecution is that on 23.02.2022 at about 04.30 pm., children were playing in front of the house of the defacto complainant. At that time, wordy quarrel arose between the accused and the defacto complainant, over which trouble has arisen and both of them caused assault to each other. Based upon the compliant given by the defacto complainant, the present case has been registered, whereas on the basis of the complaint given by the counter party, namely the petitioner herein, a case in Crime No.32 of 2022 for the offences punishable under Section 294(b) and 506(i) IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 was also registered.

3.Since it is a petty issue that has been taken place between the parties, over which the counter case has also been registered, this Court is inclined to grant anticipatory bail to the petitioners.

No.10608 of 2022 4.Accordingly, this Criminal Original Petition is allowed and the petitioners are ordered to be released on bail in the event of arrest or on their appearance, before the learned Judicial Magistrate, Singampunari, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioners shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

5.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
