ORDER
The prayer sought for herein is for a Writ of Mandamus, directing the respondents herein to sanction forthwith the third incentive increment to the petitioner, for acquiring additional higher qualification viz., M.Phil., Degree.
2.Heard, Mr.P.Muthuvel, learned counsel for the petitioner and Mr.D.Muruganantham, learned learned Additional Government Pleader, appearing for the respondents.
3.The learned counsel for the petitioner would submit that the petitioner joined on 19.07.2002 as Teacher Trainer. She acquired
the qualification of M.Sc., M.Ed., and for such qualification, from 15.09.2005, the petitioner had been given two advance incentive increments. Thereafter, from 25.09.2006, she has been promoted as PG Assistant. While so, she acquired another qualification, namely, M.Phil in April, 2011. Thereafter, she completed service and retired from service on 31.05.2016. 4.Eventhough, the petitioner acquired the higher qualification of M.Phil, in 2011 and she made representation on 08.06.2015, seeking for the third set of incentive increment for such qualification, the same was not considered and no increment was given.
Even after retirement, the petitioner has given representation on 13.02.2017 and 20.06.2018, however, none of the representations yield any result. Therefore, the petitioner is before this Court with the aforesaid prayer.
5.I have heard the learned Additional Government Pleader appearing for the respondents, who would submit that, the said requests made by the petitioner dated 08.06.2015, 13.02.2017 and 20.06.2018, would be considered and if the petitioner is eligible to the third set of incentive increment for acquiring the M.Phil., degree, necessary orders would be passed to that effect within a time frame stipulated by this Court.
6.Considering the submissions of both sides and taking into account the factual matrix of this case, this Court is inclined to pass the following order:
"The respondents are directed to consider the representations of the petitioner dated 08.06.2015, 13.02.2017 and 20.06.2018 and pass orders thereon on merits and in accordance with law, with regard to the grievances of the petitioner, to get incentive increments for acquiring of higher qualification, namely, M.Phil., from the date of such acquiring and pass orders thereon within a period of six weeks from the date of receipt of a copy of this order." 7.With this direction, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is also closed.
