Respondent Prayer : This Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records of the impugned order passed by the respondent in Letter No.K.No. 1/D11/432/Law/TNSTC/ED/2024 dated 27.03.2025 and quash the same and consequently directing the respondent not to initiate any further proceedings till disposal of the C.A.No.101 of 2024 on the file of the Principle and Sessions Judge, Karur.

ORDER

Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondent. Carefully perused the materials available on record.

2. This writ petition is filed by a Conductor working in the respondent Corporation against the show cause notice issued on 27.03.2025 to him. The respondent is found that the allegations set out against the petitioner are very grave and punishment imposed against him, was not satisfactory and accordingly they issued notice calling for the explanation of the petitioner within seven days, against the proposed punishment to be imposed against him for dismissal from service. It is made clear in the said notice that if the petitioner is not interested to give any written explanation further action will be initiated.

3. Learned counsel for the petitioner submits that he submitted an explanation on 08.04.2025. It appears that after submitting the explanation to the impugned show cause notice, the petitioner filed the present writ petition, challenging the show cause notice dated 27.03.2025. 2 / 4

4. In our considered view, at present, this Court is not inclined to interfere into the notice issued by the respondent. However, it is open to the petitioner to submit any detailed explanation to the respondent for the show cause notice dated 27.03.2025. He can submit the same within a period of two weeks from today(24.04.2025). On submission of the detailed explanation by the petitioner, the respondent shall consider the same and pass appropriate orders by following due process of law and giving opportunity for personal hearing to the petitioner thereafter.

5. With the above observation, this writ petition is disposed of.

6. Consequently, connected miscellaneous petition stands closed.

7. There shall be no order as to costs.
