The delay of 34 days is sought to be condoned.

2.Learned Counsel for the first respondent has no serious objection for the delay of 34 days in filing the Second Appeal being condoned. However, learned Counsel for the appellant fairly states that respondents 2 to 5 remain unserved. However, I find from the array of parties that respondents 2 to 5 are only formal parties and the first respondent is the contesting respondent. In the light of the above, I do not deem it necessary to await service of notice on respondents 2 to 5 for entertaining this application. 3.I have heard the learned Counsel for the parties and I have also gone through the affidavit. As already indicated hereinabove, learned Counsel for the contesting respondent fairly states that delay is negligible and could be condoned.

4.Accordingly, this petition is allowed.

5.Registry is directed to number the Second Appeal, if it is otherwise in order.
