PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to remove the encroachment made in the common pathway under Survey No.62/5 measuring East West 10 feet and North South 81 feet at Kattoorani Village, Ramanathapuram Taluk, Ramanathapuram District encroached by the fifth respondent as per the proceedings initiated by the second respondent under Na.Ka.A8/715/2020 dated 12.02.2020 by fixing the time frame.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The writ on hand has been instituted to direct the respondents to remove the encroachment made in the common pathway situated in Survey No.62/5 measuring East West 10 feet and North South 81 feet at Kattoorani Village, Ramanathapuram Taluk, Ramanathapuram District encroached by the fifth respondent as per the proceedings initiated by the second respondent under Na.Ka.A8/715/2020 dated 12.02.2020. 2/5

2.The learned Additional Government Pleader appearing for the respondents 1 to 3 submitted that the authorities conducted a survey and found that the subject property is patta land. 3.In view of the above, no further action is required. If at all the petitioner claims any right, he is at liberty to approach the competent civil Court of law.

4.With these observations, this Writ Petition is disposed of. There shall be no order as to costs.
