Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned Refusal Check Slip bearing No.RFL/KARIAPATTI/100/2025, dated 06.11.2025 issued by the respondent and quash the same as illegal and consequently direct the respondent to register and release the sale deed dated 05.11.2025 executed by the petitioner in respect of the property in S.No:152/14, S.Kallupatti Village, Kariapatti Taluk, Virudhunagar District.

ORDER

The Writ Petition challenges the impugned refusal check slip, dated 06.11.2025.

2. The petitioner being the mother and guardian of her two minor sons, Jeyapandi and Arunpandi, aged about 13 years and 10 years, respectively, is selling the property as a guardian. When the same was presented, the refusal check slip was passed on the ground that no Court permission was obtained for selling the minor share and secondly, the amount was also not obtained as a deposit in the name of the minors.

3. Heard the learned counsel appearing on behalf of the petitioner and learned Special Government Pleader appearing on behalf of the respondent.

4. It is now settled that it is for the minors to repudiate the transaction upon attaining the age of majority on the ground of want of Court permission or the amount being misused etc. The document cannot be refused to be registered. In view thereof, this Writ Petition stands allowed on the following terms: 2/4

(i) The impugned refusal check slip, dated 06.11.2025 shall stand set aside and the matter stands remanded back to the file of the respondent;

(ii) Within two weeks from the date of receipt of a web copy of the order, the petitioner shall represent the document upon which the same shall be registered, if there is no other impediment. No costs.
