This Petition is filed to condone the delay of 983 days in filing the above Civil Miscellaneous Appeal as against the judgment and decree passed in M.C.O.P.No.46 of 2018, dated 22.2.2021, on the file of Motor Accidents Claims Tribunal/Principal Subordnate Judge, Kumbakonam. 2.Heard the learned counsel appearing for the Petitioner and second respondent and perused the materials placed before this Court. The learned counsel for the Petitioner filed a memo with a prayer to dispense with the appearance of R2. The said memo is recorded. The learned counsel for R2 prays time to represent the vakalath of R2 and also stated that the second respondent has no objection in allowing this Petition.

3. In view of the no objection expressed by the second respondent and for the reasons stated in the accompanying affidavit filed in support of the 1/3

Petition and on being satisfied with the same, this Petition is allowed and the delay is condoned.

4.Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and list it for admission in the usual course. 18.09.2025 vsn 2/3
