The petitioner, who apprehends arrest at the hands of the respondent for the offences punishable under Sections 318(4) of BNS, 2023 & Section 4(1). 76(1) of Chit Fund Act, 1982, in Crime No.18 of 2026 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that A1 and A2 are very well known to the defacto complainant and they approached the defacto complainant and insisted her to invest money in the Deepavali Fund Scheme. On believing the same, he defacto complainant and other 33 persons invested the total amount of Rs.62,54,000/-. Thereafter, they failed to repay the said amount. When the same was demanded by the defacto complainant and other victims, they abused them in filthy language and threatened them with dire consequences. Hence, the case.

3. The learned counsel for the petitioners would submit that the petitioner is an innocent and he was falsely implicated in this case and he has no way connected in the above said incident. He would further submit that A1 & A2 are the husband and wife and they only collected money from the victims. Hence, he prays to grant anticipatory bail to the 2/6

petitioner.

4. The learned Government Advocate (Crl. Side) would submit that the petitioner and the other accused cheated the amount of Rs.62,54,000/- from defacto complainant and other 33 persons in the name of Deepavali Fund Scheme and the investigation is still pending. Hence, he opposes to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.

Considering the rival submissions on either side and the nature of offences charged against the petitioner, and the main allegations as against A1 & A2 and even according to the prosecution, A1 & A2 collected money and already A2 lodged a complaint on 16.10.2025 against his wife (A1) alleging that she collected money from the public and escaped with money and even according to the prosecution, the occurrence was took place on 01.01.2023 and FIR was registered very belatedly on 23.02.2026, I am inclined to grant anticipatory bail to the petitioner, subject to the following conditions: 3/6

[a] Accordingly, the petitioner is ordered to be released on anticipatory bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Judicial Magistrate Court Court-I, Madurai, and on further conditions that:

[b] the petitioner shall report before the respondent police, every Saturday at 10.30 a.m. for a period of four weeks, and thereafter as and when required for the interrogation.

[c] the petitioner shall not commit any offences of similar nature.

[d] the petitioner shall not abscond either during investigation or trial.

[e] the petitioner shall not tamper with evidence or witness either during investigation or trial. [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner 4/6

released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
