For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1469/2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioners, apprehend arrest at the hands of the respondent police for the offences punishable under Sections 406, 420 & 120B of I.P.C and Section 4(1) of Chit Fund Act in crime No.1469 of 2022, seek anticipatory bail.
2.The case of the prosecution is that the petitioners, who are the Directors of Eagle Sathish Chits Private Limited along with Accused No.3 had conducted Diwali Chit Fund and collected money from the depositors/defacto complainant and after the chit period was over, the petitioners along with other accused have misappropriated the matured amount and failed to repay the amount to the depositors. Hence, the complaint.
3.The learned counsel appearing for the petitioners would submit that the petitioners had already settled half of the amount https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.8380 of 2023 to the depositors and further, they are ready to settle the matured due amount to all the depositors/defacto complainant within a period of six months.
4.The learned Additional Public Prosecutor appearing for the respondent would submit that this is the fourth application filed by the first petitioner and earlier, the first petitioner filed a petition in Crl.O.P.(MD) No.2934 of 2023, wherein, this Court dismissed the petition on 15.02.2023. Therefore, there is no change in circumstances and hence, he opposed for granting anticipatory bail to the petitioners.
5.Taking note of the facts and circumstances, since there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioners.
6.Accordingly, this Criminal Original Petition is dismissed.
