PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Sections 493 and 506(i) of IPC, in Crime No.14 of 2017, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner has given false promise to marry the defacto complainant and had sexual intercourse with her in the year 2008. Further he promised her that after returning from Singapore, he will marry the defacto complainant. Even after return to India in the year 2017, he did not marry her. Hence the complaint.
3. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
4. The learned counsel appearing for the petitioner would submit that the alleged occurrence took place in the year 2008. There is a delay of 9 years to lodge a complaint. Further A2 and A3 already got anticipatory bail by this Court in Crl.O.P(MD)No.107 of 2017, by order dated 28.12.2017.

5.Considering the facts and circumstances of this case and delay in lodging the complaint and also no sexual offence registered as against the petitioner herein, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned District Munsif cum Judicial Magistrate Court, Karaikudi and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30.a.m., until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
