For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :-For Anticipatory bail in Crime No.457 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 5 and 7(3) of Lotteries Regulation Act 1998 in Crime No.457 of 2021, seeks anticipatory bail.
2.The case of the prosecution is that based on the secret information, the respondent police went to fish market, at that time, the police found that the petitioner was in possession of 6 lotteries in the name of Kumaran-200 lotteries, which was prohibited by the Government. On the seeing the police, the petitioner was escaped from the scene. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and the petitioner has been falsely implicated in the present case.

CRL OP(MD). No.9863 of 2021 4.The learned Government Advocate (criminal side) for the respondent strongly opposed this petition on the ground that the petitioner is a habitual offender and having three previous cases, which are similar in nature.
5.Taking note of the nature of the offence alleged to have committed by the petitioner and the fact that he is having three previous cases, which are similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner. 6.In the result, this petition is dismissed.
