Mr.A.Muthukaruppan, learned Additional Government Pleader, takes notice for the respondents 1 to 3. Notice to the respondents 4 and 5 is dispensed with in view of nature of the order to be passed by this Court.

2. The issue involved in this writ petition pertains to a

common property being enjoyed by both the petitioner as well as the private respondents.

3. The dispute in all fours appears to be purely civil in nature. Already, a suit in O.S.No.54 of 2014 has been filed on the subject matter by the petitioner. In spite of working out his rights before the Civil Court, the petitioner has approached this Court by filing the present writ petition for the same cause of action.

4. Therefore, this Court is of the considered view that the writ petition is not maintainable and it is open to the petitioner to seek appropriate remedy before the Civil Court as the dispute appears to be purely civil in nature. The writ petition is, hence, dismissed. No costs.
