RESPONDENT/COMPLAINANT Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition made in Para-6(b) of the order dated 22/5/2024 made in Crl.OP(MD) No.7311/2024 on the file of this Honble Court that the petitioner shall make a payment of Rs.25,000/-(Rupees Twenty Five thousand) in favour of "Headmistress, Arasu Magalir High School, Address : Government Girls High School, Kottampatty, Melur, in SBI Account No.30636647339, IFSC No.SBIN0000258. This fund shall be utilized for the purpose of purchasing furniture (Benches & Desks) for newly constructed class rooms under "Namakku Name" Scheme. After payment, the petitioner shall produce the receipt/acknowledgment before the concerned Court along with surety affidavit.

Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.PNSSM.AMMAAR, Advocate for the petitioner and of MR.B.THANGA ARAVINDH, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- 1/3

This petition is filed seeking modification in Crl.OP(MD) No.7311 of 2024, dated 22.05.2024.

2.The learned counsel appearing for the petitioner submits that this Court by an earlier order dated 22.05.2024, directed the petitioner to deposit a sum of Rs.25,000/- to the credit of Government Girls High School, Kottampatty, Melur. The petitioner could not mobilize the said amount and therefore, he was unable to come out on bail, even though bail was granted on 22.05.2024. Accordingly, he prays to modify the above said condition.

3.Considering the submission of the learned counsel appearing for the petitioner, the condition imposed by this Court is modified to the effect that the petitioner shall deposit a sum of Rs.20,000/- to the credit of Government Girls High School, Kottampatty, Melur. Accordingly, this criminal miscellaneous petition is allowed.
