PRAYER: Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to call for the records of the first respondent, learned Executive Magistrate / Tahsildar vide his proceedings in Na.Ka.No.A1/2882/18 dated 26.06.2018 and quash the same.

ORDER

This Criminal Original has been filed to quash the proceedings initiated by the first respondent under Section 107 of Cr.P.C.

2. From the records, it is seen that the first respondent has issued a Show Cause notice dated 26.06.2018 to the petitioners, calling them to show cause as to why they should not be ordered to execute a bond for keeping peace for a period of one year. The reason for issuance of show cause notice is also found in the very notice itself.

3. It is the case of the petitioners that the petitioners 1 to 4 are Government Employees and they are being continuously harassed by the first respondent, by calling them for enquiry. It https://hcservices.ecourts.gov.in/hcservices/

is also the contention of the learned counsel appearing for the petitioners that reply has been given for the show cause notice issued by the first respondent.

4. This Court does not find any ground to quash the proceedings against the petitioners initiated by the first respondent. However, this Court deems it fit to direct the first respondent to complete the enquiry within a period of three weeks from the date of receipt of copy of this order. The petitioners are directed to co-operate with the enquiry to be conducted by the first respondent in order to enable him to complete the proceedings within a period of three weeks.

5. The Criminal Original Petition stands disposed of with the above directions.

Consequently, the connected miscellaneous petitions are closed.
