Respondents Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondent to grant 30 days leave from 01.05.2026 to 30.05.2026 (Parole) to the petitioner's brother-inlaw namely Tamilvanan, son of Subramanian in C.P.No.524265, who is in Central Prison, Madurai, to take care of his wife for her heart operation.

O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This Writ Petition is filed for issuance of a Writ of Mandamus, directing the respondents to grant 30 days leave to the convict, who is presently serving sentence at Central Prison, Madurai.

2. The Inspector of Police, Koodalur North Police Station, Theni, is suo motu impleaded as the third respondent in this case.

3. The petitioner is the brother-in-law of the convict. He made a representation, dated 24.03.2026, to the first respondent seeking 30 days leave on the ground that the wife of the convict is afflicted with heart disease and that an immediate operation has been advised by the Doctor in order to save her life. Since the representation was not considered, the present Writ Petition came to be filed before this Court.

4. When the matter was taken up for hearing today, the learned Additional Public Prosecutor produced the proceedings of the first respondent, dated 27.04.2026. It is seen that three days emergency leave has been granted to the convict with police escort.

5. Considering the facts and circumstances of this case and the order that has been passed by the first respondent, we are inclined to modify the condition to the effect that the convict will report before the newly impleaded third respondent, daily at 6.00 PM during the entire emergency leave period. The other conditions imposed by the third respondent shall remain as they are.

6. This Writ Petition (Criminal) is allowed with the above directions. No costs.
