Heard Mr.S.Visvalingam, learned counsel appearing for the petitioner, Mr.H.Arumugam, learned counsel appearing for respondent Nos.1 and 2 and Mr.S.Ramakrishnan, learned counsel for Mr.K.Rajesh, learned counsel appearing for the third respondent.

2. This Writ Petition has been filed challenging the order passed by the second respondent by transferring the petitioner from Shop No.7522 to Shop No.7535 of the same Taluk. Since the transfer order has got a word 'administrative interest', the petitioner had filed this Writ Petition challenging the same on the ground that it is a stigmatic order and the same has been passed without giving him any opportunity.

3. The petitioner has not been transferred from one shop to another shop in the same Taluk where both the shops are situated. When any transfer is made on administrative reasons, it cannot be expected that every such action should 2/4

be done with the approval of the employee. The respondents are not without power to effect the transfer in the administrative interest and that too, within the Taluk, I do no find any illegality in the order.

4. However, it is open to the petitioner to make any application, if at all he is aggrieved for considering him to post in any of the shops as he prefers and it can be considered on merits and other suitability.

5. With the above observation, this Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 09.07.2024 NCC:yes/no Index:yes/no Internet:yes/no TSG To The District Collector, Theni District, Theni.
