RESPONDENTS Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to issue a Writ of Mandamus directing the district magistrate cum District Collector, Kanyakumari District at Nagercoil to take appropriate action including the passing of orders under Section 18 of The Immoral Traffic (Prevention ) Act 1956 against the private respondent within a timeframe and consequently direct the respondents 1 to 4 to effectively restrain the private respondent from carrying on prostitution in Pioneer Senthil Kumar Lodge, Vadasery, Nagercoil.
ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.N.DILIP KUMAR, Advocate for the petitioner and of M/S.S.BHARATHI, Government Advocate (Crl. Side) for R1 to R4 and MR.B.BRIJESH KISHORE, Advocate for R5, the court made the following order:- The petitioner is a landlord of certain lodge which is now under lease to the fifth respondent. The petitioner complains that no action is initiated against him under the Immoral Traffic (Prevention) Act, 1956.

2.Technically, this is a matter, where the petitioner ought to have moved the concerned Magistrate for appropriate direction, since the case has not been registered. If it is aggrieved that no First Information Report was registered based on her complaint, yet, inasmuch as both the sides conceded that there are civil litigations between the landlord and the tenant, this Court suggests both the parties to explore the possibility of the mediation settlement, for which, both sides are consented.
3.Accordingly the matter is referred to the Mediation and Conciliation Centre attached to this Bench. Both the parties are directed to appear before the Mediation and Conciliation Centre attached to this Bench on 15.04.2019 at 03.00 p.m. 4.Post the matter before this Court after the mediation process is completed.
