ORDER

This Criminal Original Petition has been filed to direct the first respondent to withdraw the case in Crime No.440 of 2021 from the file of the third respondent and transfer the investigation in Crime No.440 of 2021 on the file of the third respondent to the file of the second respondent.

2.The learned Government Advocate (Criminal Side) appearing for the respondents would submit that after completion of investigation, the third respondent has already filed the final report in Crime No.440 of 2021 on 02.08.2021 before the learned Judicial Magistrate No.VI, Madurai, but the same has not been taken on file. https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.9884 of 2021 3.In view of the above submission, transfer of investigation does not arise, since no investigation is pending on the file of the third respondent. Accordingly, this Criminal Original Petition is dismissed.
